Wizard’s Workshop Copyright, Originality, and Content Policy
1. Original Work Only
Sellers may list only original artwork or work they have legally sufficient rights to sell and license. Unauthorized copies, stolen artwork, franchise-specific fan art, protected characters and logos, and works that infringe third-party intellectual property rights are prohibited. Generic fantasy themes alone are not a license to copy protected expression.
2. Human-Created Art
Listings marketed as human-created must meet World Wizard’s no-generative-AI rule. Sellers must not falsely label AI-generated or materially AI-created artwork as human-made. [OPEN DEFINITION: distinguish generative AI from ordinary digital editing and accessibility tools before publishing.]
3. Seller Responsibilities
Sellers must maintain evidence of ownership or licensing where reasonably available and respond to legitimate rights inquiries. Administrative approval is not a guarantee of ownership or noninfringement.
4. Reporting Copyright Concerns
Copyright owners or authorized agents may submit notices to World Wizard’s designated DMCA contact: [REGISTERED AGENT NAME, EMAIL, MAILING ADDRESS, AND OTHER REQUIRED DETAILS]. Reports should identify the copyrighted work, the allegedly infringing material and its location, contact details, a good-faith statement, an accuracy/authority statement under penalty of perjury, and a physical or electronic signature, consistent with 17 U.S.C. § 512(c)(3).
5. Response to Notices
World Wizard will review notices, act expeditiously on sufficiently compliant notices where required, and may disable access to disputed material while it investigates. World Wizard may preserve relevant records and notify the affected seller. Decisions will account for the applicable statutory procedure and legal advice where needed.
6. Counter-Notices
A seller who believes material was removed by mistake or misidentification may submit a counter-notice meeting applicable DMCA requirements, including contact details, identification of removed material, required statements, consent to jurisdiction where applicable, and signature. Where a valid counter-notice is received, World Wizard will follow the statutory notification and restoration process, including the applicable waiting period, unless notified of a court action. [ATTORNEY REVIEW REQUIRED: exact workflow and jurisdictional language.]
7. Repeat Infringers
World Wizard will maintain and reasonably implement a policy to terminate repeat infringers in appropriate circumstances. Outcomes may include warnings, listing removal, suspension, and account termination. World Wizard may act more promptly in serious cases.
8. No General Certification
Manual review is intended to enforce marketplace standards; it is not a legal opinion, copyright registration, or certification of a seller’s rights.
9. DMCA Agent Registration
World Wizard must designate and register its agent with the U.S. Copyright Office and publish the required agent contact information. Confirm registration, renewal, and monitoring obligations before publication.
